Interpretation

 

  1. General Terms and Conditions.
    1. M/S CustomsNet Sdn. Bhd. (209235-A) (hereinafter referred to as the"CustomsNet") is the owner of the www.ecustomsnet.com service (hereinafter referred to as "the Service").
    2. The service is offered to you conditional upon your acceptance without modification of the terms, conditions, and notices contained herein.
    3. CustomsNet reserves the right, at its sole discretion, to change any or all of the provisions of this Agreement at any time without prior notice. CustomsNet will notify Subscriber(s) of any changes by posting them on the Service or by sending it by registered post to his/her last known address.
    4. CustomsNet reserves the right, at its sole discretion, to change, limit, or discontinue in any aspect the contents or features of the Service, as well as in any aspect pertaining to the use of the Service. CustomsNet further reserves the right, at its sole discretion, to restrict the use of the Service as well as suspend or revoke the Subscriber’s rights to use the Service based on CustomsNet’s belief that Subscriber’s use of the Service would violate the terms and conditions herein contained or any applicable law for the time being inforce.

  1. Member Account, Password and Security
    1. Upon completion of the registration form, the Subscriber(s) will choose a login name and a password (which could be changed subsequently). The subscriber(s) is entirely responsible for maintaining the confidentiality of the password and account. Furthermore the Subscriber(s) is entirely responsible for any of the activities that occur under his/her account.
    2. The Subscriber(s) agrees to notify CustomsNet immediately of any unathorised use of his/her account or any other breach of security.
    3. CustomsNet will not be held responsible for any loss incurred by the Subscriber(s) as a result of unauthorised access of his/her password or account. However, the Subscriber(s) may be held liable for losses incurred by CustomsNet or another party due to unauthorised access of his/her account or password.

    4. Multiple passwords may be allowed upon Subscriber’s request for an additional fees and the Subscriber(s) shall be subjected to the same terms and conditions of the first password and login name.

     

  2. Rights in Service Content and the Service
    1. The Subscriber(s) may download contents from the Service solely for his/her personal and non-commercial use, but will make no other use of the contents without the express written permission of CustomsNet.
    2. Subscriber shall not modify, publish, distribute, transmit, participate in the transfer of sale, create derivative works, or in any way exploit in whole or part of, any of the contents, found in the Service.
    3. Subscriber shall not make any change(s) to any of the content(s) that has been downloaded under this Agreement, and in particular he/she shall not delete or alter any proprietary rights or attribution notices in any of the contents.
    4. Subscriber agrees that he/she does not acquire any ownership rights in any of the downloaded contents. Subscriber further agrees that all rights in the Service and any of the content found on the Service not granted to him/her under this Agreement are expressly reserved by CustomsNet.

     

  3. Subscriber’s Activities and Subscriber’s Information on the Service
    1. Subscriber warrants that any material or information made available through the Service by the subscriber including, postings to notice boards and directories, is considered solely his/her original work, and/or that he/her has obtained all necessary rights (if any) to make the material or information available on the Service. Subscriber will be solely responsible for the content of any material or information that he/she makes available through the Service and shall also be liable for any damage caused resulting from his/her making of any material or information available through the Service.
    2. By making any material or information available through the Service, for example, in postings to chat areas and forums, the Subscriber automatically grant to CustomsNet a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, distribute and sublicense any such material or information (in whole or in part) and/or to incorporate it in other works regardless of form, media, or technology.
    3. By making any material or information available through the Service, the Subscriber also grant to other subscribers the right and licence to access, view, store, or reproduce his/her material and information for their personal use.
    4. CustomsNet has no obligation to, and does not and cannot, review every item of material or information that the Subscriber make available through the Service and CustomsNet is not responsible for any contents of these material or information. However, CustomsNet reserves the right to delete or edit any material or information of its sole discretion that it deems, unacceptable, libelous, defamatory, obscene, pornographic, abusive, or otherwise in violation of any law for the time being in force or that infringes or violates any rights of any other person or entity. Further, CustomsNet reserves the right at all times to disclose any material or information as necessary to satisfy the requirements of any law, regulation, or on governmental request.
    5. CustomsNet reserves the right to collect and use data about the Subscriber and his use of the Service for purposes statistical analyses to assist in improving the Service. CustomsNet further reserves the right to distribute such data in forms that do not identify Subscriber individually or reveal his/her identity. CustomsNet may also distribute such data in forms that identify subscriber individually or reveal his/her identity, but only with his/her consent to such distribution.

     

  4. No Unlawful or Prohibited Use
    1. As a precondition to the use of the Service, the Subscriber will not use for any purpose that is unlawful or prohibited in violation of these terms and conditions herein contained.
    2. Subscriber may not use the Service in any manner which could damage, disable, overburden, impair or interfere with any other party’s use and enjoyment of the Service. Subscriber may not attempt to gain unauthorized access to any www.ecustomsnet.com service, other accounts, computer systems or networks connected to any Service, through hacking, password mining or any other means. Subscriber may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the services.

     

  5. Disclaimer of Warranties & Limitation of Liability
    1. Subscriber expressly agrees that the use of the Service is at his/her own risk. Neither CustomsNet nor any of its subsidiaries, affiliates, employees, agents, distributors, third party content providers, or licensors (and their respective directors, officers, employees, and agents) warrant that the Service will be uninterrupted or error free, or as to the accuracy, reliability, completeness, or contents of any advice, material, information, postings, or posting responses found on the Service, any merchandise or services provided through the Service, or any links to other sites or services made available on the Service.
    2. Although maximum care has been taken to ensure accuracy in the compilation of this publication, CustomsNet cannot accept any responsibility for any error or omission.

     

  6. Interpretation
    1. Words importing the masculine gender shall be deemed and taken to include the feminine and neuter genders and the singular to include the plural and vice versa.
    2. Law means the law of Malaysia.
